If a faction is completely destroyed, their leader - whether a normal or Legendary Lord - will no longer appear in the game under normal circumstances.

Notable exception: when playing as Norsca and you beat another faction's leader in battle, you may choose to permanently kill them if you like. Theodoric Gausser of Nordland being confederated by Karl Franz - they will also respawn after being defeated in battle. More ordinary faction leaders benefit from a similar effect in that, until they are confederated by a playable faction - eg. A Legendary Lord/Hero (the latter being very rare), any Tomb King Lord, or a normal Lord/Hero who has reached level 20 and taken the Immortal skill, cannot be permanently killed.
